I have been in an Oregon car accident, what are my legal responsibilities? +

At the time of the Oregon car accident you are required to STOP – Render Aid – Exchange Information – Report the Accident. Under no circumstances should you leave the Oregon car accident site or aggravate an already emotional experience.

I'm being pressured to provide a recorded statement and sign a medical release by both insurance companies -- must I do so? +

You are under no obligation to discuss the car accident or your medical treatment with the other driver’s insurance company, and in fact, doing so could hurt your claim. Do NOT talk to the other driver’s insurance company or give them a recorded statement!

How do I get reimbursed for property damage incurred in an Oregon car accident? +

Collision insurance is the type of insurance that covers the cost of repairing (or replacing) your vehicle after it was involved in an Oregon car accident. This coverage is not mandatory in Oregon and must be specifically included in your insurance policy.

Do I have to call the Portland Police for a minor fender bender? +

Not always. In Portland, police generally only respond if there are injuries, a blocked roadway, a hit-and-run, or a driver under the influence. However, Oregon law requires you to file an Oregon Traffic Accident and Insurance Report with the DMV within 72 hours if there is an injury or if property damage exceeds $2,500.

Where do I get a copy of my Portland Police Bureau (PPB) traffic accident report? +

You can request a copy through the PPB Records Division at the Justice Center (1111 SW 2nd Ave) or online via the Portland.gov portal. Note that if officers only issued a “Traffic Crash Exchange Report” at the scene, that may be the only official document available.

What happens if I didn't file my Oregon DMV accident report within 72 hours? +

Failing to report an accident that meets the $2,500 threshold or involves injury can lead to a suspension of your driving privileges. You should submit the report as soon as possible, even if the 72-hour window has passed.
