Oregon Permissive Driver Case – Ruling Reversed & Legal Fees Awarded

As a follow up to our recent victory against GEICO Insurance in the disputed Oregon permissive driver case, Robert Ma v. GEICO Casualty Company, the Oregon Court of Appeals awarded our client his attorney fees in the amount of $50,000. GEICO’s decision to save a few dollars by wrongfully denying our client his collision related medical expenses of just over $8,000 cost GEICO a whole lot more. In the end, GEICO paid $61,187.49 in medical expenses, court costs, attorney fees and interest.

Appeals Court Reverses Oregon Permissive Driver Ruling

Perhaps more importantly, it is now settled law that an Oregon permissive driver of an insured vehicle is entitled to personal injury protection (“PIP”) coverage when they are injured in a car accident. Simply stated, if you provide permission to an individual to drive your car, that individual is entitled to PIP insurance benefits if they are injured in an Oregon car accident. For years insurance companies have denied PIP benefits to permissive drivers by aggressively interrupting Oregon statutes. Now all Oregonians can benefit from a closed loop-hole.
